1. Who we are

This website, myeverboard.com, is operated by EverPlay Studios Inc., a Florida corporation, doing business as EverBoard Inc (“EverBoard,” “we,” “us,” “our”). Our address is 700 NE 26th Terrace, Unit 1403, Miami, Florida 33137, United States.

2. What this policy covers

This policy explains what we collect when you visit myeverboard.com and when you sign up to hear from us. That is all this site does today: it tells you about the EverBoard Digital Game Console, links you to the retailer that sells it if you want to buy one, and lets you give us an email address if you want product news. You cannot buy anything on this site and you cannot create an account here.

This policy does not cover:

The EverBoard console itself, the EverVibe Game Creator, or an EverPass subscription. Those have their own privacy notice, which we provide when you set up a console and which will be published before the product ships.

The retailers who sell EverBoard — Best Buy in the United States, Argos in the United Kingdom. When you follow a link from this site to a retailer, you are on their website. Anything you do there — browsing, creating an account, buying — is governed by their privacy policy, not ours. We do not receive your order details.

Other sites we link to, including our social accounts.

3. Information we collect

Information you give us. If you sign up for updates, we collect your email address, and your first name and country if the form asks for them and you provide them. If you email us, we receive whatever you put in that message.

Information collected automatically. Like most websites, when you visit we automatically receive:

your IP address and the approximate location it suggests (usually city or region level, not a precise location);

your browser and device type, operating system, and screen size;

the pages you viewed, when, for how long, and the site or ad that referred you;

and similar technical information recorded by cookies and comparable technologies.

We do not ask for, and this site does not need, any sensitive information. Please don’t send us health information, government ID numbers, or payment card details — we have no way to take payment on this site and never ask for card numbers here.

4. How we use information

We use what we collect to:

send you the product updates you asked for, and nothing else you didn’t ask for;

operate, secure, and troubleshoot the website;

understand which pages and campaigns people find useful, in aggregate, so we can improve the site;

respond when you contact us; and

comply with law and enforce our Terms of Use.

We do not use your information to make automated decisions that produce legal or similarly significant effects about you.

5. Legal bases (visitors in the UK and EEA)

Where UK or EU data protection law applies, we rely on: your consent for marketing emails and non-essential cookies (you can withdraw it at any time); our legitimate interests in running, securing, and improving the site; and legal obligation where the law requires us to keep or produce records.

6. Cookies and similar technologies

We use a small number of cookies and similar technologies:

Strictly necessary — needed for the site to load and stay secure.

Analytics — to count visits and see which pages are read. We use Google Analytics.

Advertising and measurement — we use advertising and measurement pixels so we can show EverBoard ads to people who may be interested and see whether those ads work. These are the Meta pixel (Facebook and Instagram), Google Ads and Google/YouTube measurement, and the Reddit pixel, together with Google Tag Manager, which loads them. They set cookies and send the ad platform information about your visit, including your IP address and the pages you viewed.

We show a cookie banner, and on first visit we do not set analytics or advertising cookies until you accept them.

Most browsers let you block or delete cookies in their settings. Blocking analytics or advertising cookies will not stop the site from working. We honor the Global Privacy Control (GPC) signal as a valid opt-out of sale, sharing, and targeted advertising.

7. How we share information

We share personal information:

With advertising and analytics platforms, through the pixels described above — Meta Platforms, Google, and Reddit.

See section 8 — under several US state privacy laws this counts as “selling” or “sharing,” and you can opt out.

With service providers who work for us and are contractually limited to that work — Shopify (website hosting and platform), Klaviyo (email), and Google Analytics (site analytics).

With professional advisers (lawyers, accountants, auditors) where needed.

When the law requires it, or to protect our rights, our users, or the public.

In a business transfer — if EverPlay Studios is involved in a merger, acquisition, or sale of assets, your information may transfer with the business. We’ll say so here if that happens.

8. Selling, sharing, and targeted advertising

We do not sell your personal information for money, and we never sell or share the personal information of anyone we know to be under 16.

However, because we use advertising pixels, we do “sell” and “share” personal information as those words are defined in the California Consumer Privacy Act, and we process it for “targeted advertising” as defined in other US state privacy laws. The categories involved are identifiers (IP address, advertising and cookie identifiers) and internet or network activity (pages viewed, referring site). The recipients are the advertising platforms named in section 6.

To opt out, use the “Your Privacy Choices” link in the footer of every page, adjust your choices in our cookie banner, or send a browser-level Global Privacy Control signal — we treat GPC as a valid opt-out. You can also email [legal@everplaystudios.com](mailto:legal@everplaystudios.com).

9. How long we keep information

Email sign-ups: until you unsubscribe, or after 24 months of no opens or clicks, whichever comes first. We keep a minimal suppression record after you unsubscribe so we don’t email you again by mistake.

Website analytics: 14 months.

Emails you send us: up to 24 months after the matter is closed.

We delete or de-identify information when we no longer need it for these purposes or to meet a legal obligation.

10. Security

We use reasonable administrative and technical measures — encryption in transit, access controls, and vendors chosen for their security posture — to protect information. No website can promise perfect security, and we don’t.

11. Children

This website is not directed to children, and it is not where our product experience lives. You must be 18 or older to sign up for email updates. We do not knowingly collect personal information from children through this website.

If you believe a child has given us information through this site, email [legal@everplaystudios.com](mailto:legal@everplaystudios.com) and we will delete it promptly.

(Note for the EverBoard console: the console is a family product and has its own privacy notice and parental-consent flow, published separately, which addresses children’s privacy including the US Children’s Online Privacy Protection Act and, for the UK, the ICO’s Children’s Code.)

12. Your choices

Unsubscribe from any marketing email using the link at the bottom of it, or email [legal@everplaystudios.com](mailto:legal@everplaystudios.com).

Cookies and ad tracking — use the “Your Privacy Choices” link in our footer, change your choices in the cookie banner, or control cookies in your browser.

Global Privacy Control — we honor it as an opt-out of sale, sharing, and targeted advertising.

13. Your rights — United States

Depending on where you live, you may have the right to know what personal information we hold about you, to get a copy of it, to correct it, to delete it, and to opt out of sale, sharing, targeted advertising, or certain profiling. These rights exist under laws including the California Consumer Privacy Act as amended, and comparable laws in Colorado, Connecticut, Virginia, Texas, Oregon, Montana, and other states.

Categories we have collected in the last 12 months: identifiers (email address, IP address, cookie and advertising identifiers); internet or network activity (pages viewed, referring site); and approximate location inferred from IP address. We collect these from you directly and automatically as described in section 3, and use them for the purposes in section 4. As described in section 8, identifiers and internet activity are sold or shared with advertising platforms; nothing else is.

To make a request, email [legal@everplaystudios.com](mailto:legal@everplaystudios.com) with “Privacy request” in the subject line. We will verify your request by replying to the email address we hold for you, and we will respond within the time the law allows. You may use an authorized agent. We will not discriminate against you for exercising these rights. If we deny your request and you are in a state that provides an appeal, you may appeal by replying to our decision; if we deny the appeal, you may complain to your state Attorney General.

California “Shine the Light”: we do not share personal information with third parties for their own direct marketing.

14. Your rights — United Kingdom and EEA

If you are in the UK or the EEA, you have the right to access, correct, delete, restrict, or object to our processing of your personal information, to data portability, and to withdraw consent at any time. Withdrawing consent does not affect processing that already happened.

Our service providers may store or process information in the United States. Where we transfer personal information out of the UK or EEA, we rely on the UK International Data Transfer Addendum or the European Commission’s Standard Contractual Clauses, as applicable.

You can complain to your data protection authority. In the UK that is the Information Commissioner’s Office, ico.org.uk.

15. Changes to this policy

If we change this policy we will update the date at the top and, where the change is significant, tell you by email or a notice on the site.
